§ 19-1. General.

  • (a)

    The provisions of this chapter are adopted to provide minimum standards to ensure effective construction stormwater management, drainage control, and erosion and sediment control measures for all new construction, additions, and alterations. It is the contractor's responsibility to ensure that the requirements of this chapter are met. No final inspection shall be made until the requirements of this chapter are met.

    (b)

    It shall be the contractor's responsibility to ensure compliance with applicable Alabama Department of Environmental Management (ADEM) Construction Stormwater Management Administrative Code Chapter 336-6-12, as amended, and/or any applicable ADEM construction site permit requirements, which are designed to prevent/minimize to the maximum extent practicable the discharge of sediment and other potential pollutants in construction stormwater runoff to ensure the protection of water quality in accordance with applicable federal and state law.

    (c)

    It shall be the contractor's responsibility to ensure that all Best Management Practices (BMPs) implemented pursuant to the requirements of this chapter are implemented and maintained in accordance with established, industry standard, good engineering practices, and ADEM requirements.

    (d)

    Upon notice, the contractor shall promptly implement effective BMPs and/or repair/improve any deficient BMPs pursuant to the requirements of this chapter. Land disturbing activities shall not commence without prior approval and the installation of BMP's.

    (e)

    Failure to comply with the requirements of this chapter may subject the contractor to fines, and suspension and/or termination of City of Eufaula approval for continued construction, as may be authorized by the City of Eufaula Code, and may result in notification of such to ADEM, as appropriate.

    (f)

    Upon request, the contractor shall promptly provide proof of compliance with ADEM Construction Stormwater Management Administrative Code Rules, as amended, and/or applicable ADEM construction site permit requirements.
