§ 1-11. Certain ordinances not affected by Code.

  • (a)

    Nothing in this Code or the ordinance adopting this Code shall be construed to repeal or otherwise affect the validity of any of the following:

    (1)

    Any ordinance promising or guaranteeing the payment of money for the city, or authorizing the issuance of any bonds of the city or any evidence of the city's indebtedness.

    (2)

    Any appropriation ordinance, including those providing for or related to an annual budget, or prescribing salaries for city officers and employees.

    (3)

    Any ordinance describing the boundaries of the city, annexing territory to the city or discontinuing territory as a part of the city.

    (4)

    Any ordinance granting any franchise.

    (5)

    Any zoning ordinance.

    (6)

    Any ordinance adopting or affecting the license code or requiring or related to any privilege or occupational license or tax, including alcoholic beverages.

    (7)

    Any ordinance assessing or related to taxes, including any license tax, ad valorem tax, gross receipts tax, cigarette tax, tax on the sale or distribution of gasoline or other liquid motor fuels and kerosene, license tax for taxpaying gas districts or license tax for furnishing rooms or lodging to transients.

    (8)

    Any ordinance pertaining to the housing authority.

    (9)

    Any ordinance pertaining to natural gas.

    (10)

    Any ordinance ordering an election.

    (11)

    Any ordinance making appointments to positions, offices or boards.

    (12)

    Any ordinance providing for local improvements or levying assessments for public improvements.

    (13)

    Ordinances authorizing deeds, leases, contracts or other such instruments.

    (14)

    Ordinances under which vested rights may have accrued as to persons in whom such rights may have vested.

    (15)

    Any ordinance dedicating, accepting, naming, establishing, locating, relocating, opening, paving, widening or vacating any street or other public way in the city or relating to municipal street maintenance agreements with the state or establishing or prescribing grades for streets in the city.

    (16)

    Any ordinance establishing or relating to any public corporation or board not in this Code.

    (17)

    Any ordinance which, by its own terms, is effective for a stated or limited term.

    (18)

    Any ordinance dedicating or accepting any subdivision plat.

    (19)

    Any ordinance adopted for purposes which have been consummated.

    (20)

    Any ordinance which is temporary, although general in effect.

    (21)

    Any ordinance which is special, although permanent in effect.

    (b)

    All such ordinances are recognized as continuing in full force and effect to the same extent as if set out at length in this Code.
